IP and Patent Filing: How to Protect an Invention Abroad
A patent gives you the exclusive right to make and sell an invention for a limited time. The protection is local. A patent filed in one country does not cover another, so you choose where to file.
What can be protected Patents cover new inventions that are not obvious and can be used in industry. Many offices also register designs and some offer utility models, which are a lighter form of protection. Ideas alone and business methods are often excluded, and the rules differ by country.
Keep it secret until you file In most countries a public disclosure before filing can stop you from getting a patent. That includes selling the product and showing it at a trade fair. File first and talk about it afterwards.
Filing abroad The first filing gives you a priority date. After that you usually have about a year to file in other countries and keep the same date. An international application through the Patent Cooperation Treaty lets you start in many countries with one filing. Regional systems such as the European Patent Office can cover several countries at once.
What an application contains A description of the invention and its claims and any drawings. The claims define what you protect so they matter most. Many applicants use a patent attorney to draft them.
Costs and timing Patents are examined by the office and that takes time. Fees add up over the life of the patent because most countries charge renewals each year. Plan which countries matter most to your sales before you file widely.
Tips Search for existing patents before you file. Keep records of who invented what and when. Ask the office named on your country page about its current process.
These are general guides, not legal advice. Rules differ by country and by product and they change often. Confirm the details with the regulator named on your country page or with an expert before you act.
